Terms of use

Part A covers individuals using the free ApplyAI profile. Part B covers organisations using the Adopt AI Equilibrium platform.

These terms are between you and [AJILITY ENTITY NAME] (ABN [ABN]), trading as ApplyAI and Adopt AI. Read them with our privacy policy.

Part A — Individuals (ApplyAI)

The service is free

The AI Adaptation Profile is free to complete. We may change, pause or withdraw the free service at any time. If we withdraw it, we will give reasonable notice where we can.

Outputs are advisory

Every score is an estimate and is shown with a stated range. Your profile is guidance for your own reflection and practice. It is not a diagnosis, not an assessment of your worth, and not a prediction of any outcome.

We make no guarantee about employment, promotion, income or any other career outcome. See limitations for what the profile can and cannot support today.

You must be 18 or over

The profile is for working adults. Do not use it if you are under 18.

You own your result

Your result is yours. You can share it, export it or ask us to delete it at any time. We keep the rights in the instrument, the item bank, the scoring engine and the report templates.

Acceptable use

Answer honestly and for yourself. Do not scrape the item bank, automate submissions, attempt to extract items or scoring logic, resell access, or interfere with the service or other people's data.

Liability and the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Those non-excludable guarantees are expressly preserved.

Beyond those guarantees, and to the maximum extent the law permits, our liability for a free service is limited to resupplying the service or the cost of resupply, and we are not liable for indirect or consequential loss.

Part B — Organisations (Adopt AI / Equilibrium platform)

Aggregate outputs only

The customer receives aggregate outputs only. Individual answers, individual item data, and individual scores are never disclosed to the customer, and no reporting is produced until at least five people have completed.

No sole-basis decisions, and no ranking

The customer agrees not to use any output as the sole basis for a decision with a legal or similarly significant effect on a person, and to keep an accountable human decision-maker for any decision an output informs.

The customer agrees not to use outputs to rank, rate or compare individuals. Recruiter features produce review-gated interview preparation topics only.

Lawful invitations and the collection notice

The customer will only invite people it has a lawful basis to invite, will show them the collection notice we supply before they begin, and will not compel participation or penalise non-participation.

Data location

Customer and participant data is stored in Australia, in the Sydney region, with the sub-processors named in our privacy policy.

Fees

Fees, seat counts and term are set out in the order form or platform agreement. Where no order form applies, the published rates at the time of purchase apply.

Calibration pricing and what is reported

During calibration, results are reported as bands with their uncertainty shown. Percentiles are not reported until observed norms are published, and the customer accepts that as a condition of calibration pricing.

Termination and data export

Either party may terminate at the end of a term, or earlier for material breach that is not remedied within 30 days. On termination the customer may export its aggregate reports and configuration for 30 days, after which data is deleted or minimised under the retention policy in force.

Governing law

These terms are governed by the laws of Western Australia, and both parties submit to the courts of that state.
